Scope of Application

Article 1:

1. Accommodation contracts and related agreements concluded by the hotel with guests shall be in accordance with the provisions of these general terms and conditions

2. In the event that the Hotel accepts a special agreement to the extent that it does not contravene laws, ordinances, and custom, it shall, notwithstanding the provisions of the preceding paragraph,

be bound by such special agreement.

2. If the Hotel agrees to a special agreement that is not contrary to law and custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.

In the event that the hotel accepts a special agreement that is not in violation of laws, ordinances and customs, such special agreement shall prevail notwithstanding the preceding paragraph.

Application for accommodation contract

Article 2:

1. A person wishing to apply for a contract of accommodation at this hotel shall provide the following information to this hotel

1) Name of the guest

2) Date of stay and estimated time of arrival

3) Room charge (in principle, based on the basic room charge in Appendix 1)

4) Other items deemed necessary by the hotel

2. In the event that a guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during his/her stay

, the hotel will notify the guest of such request to the effect that the guest's stay will be extended beyond the date of stay.

When a guest makes such a request during his/her stay,

this hotel will treat it as if he/she had made a new application for a contract of stay

The hotel will treat it as if a new accommodation contract had been made at the time such a request is made

Establishment of accommodation contract

Article 3:

1. The accommodation contract shall be concluded when this hotel accepts the application as stipulated in the preceding article.

However, this shall not apply when this hotel proves that it has not given its consent.

2. When a contract of accommodation has been concluded pursuant to the provisions of the preceding paragraph, the basic room charge for the period of stay (3 days if the period exceeds 3 days

and the balance, if any, shall be applied to the final room charge payable by the guest.

The balance, if any, will be returned upon payment of the fee in accordance with Article 12.

5. If the application fee stipulated in paragraph 2 is not paid by the date specified by the hotel in accordance with the same paragraph,

the remaining amount, if any, will be returned upon payment of the room charge in accordance with Article 12.

5. In the event that the application fee stipulated in paragraph 2 is not paid by the date designated by this hotel pursuant to the provisions of said paragraph, the accommodation contract shall cease to be effective. However, in specifying the date

for the payment of the application fee, the hotel will not be liable for any loss or damage incurred.

Only in the event that this hotel has notified the guest to that effect when specifying the

date

for payment of the application fee, the contract of accommodation shall cease to be effective.

The payment of the deposit is not required.

Special provisions not requiring payment of the application fee

Article 4:

1. Notwithstanding the provisions of paragraph 2 of the preceding article, this hotel shall not require the payment of the application fee

after the conclusion of the contract.

is not required after the contract is concluded.

In the event that this hotel does not request payment of the deposit in accordance with paragraph 2 of the preceding article upon acceptance of the accommodation contract, or does not specify the date by which said deposit is to be paid, it shall be deemed to have complied with the covenant

Infection prevention measures at the facility

Article 4-2:

The hotel shall request those who intend to stay at the hotel to comply with the Ryokan Business Law (Law No. 138 of 1948)

Article 4-2:

The hotel will not accept any requests for cooperation in infection prevention measures at the facility.

The Hotel may request cooperation in accordance with the provisions of Article 4-2, Paragraph 1.

Refusal to enter into an accommodation contract

Article 5:

The Hotel may refuse to enter into an accommodation contract in the following cases.

However, this paragraph shall not apply to cases other than those listed in Article 5 of the Ryokan Business Law in which this hotel may refuse

to accommodate guests.

However, this paragraph does not mean that the Hotel may refuse to accommodate guests in cases other than those listed in Article 5 of the Ryokan Business Law.

1. When the application for accommodation is not in accordance with these General Terms and Conditions.

2. When there is no room available due to full occupancy.

3. When there is a risk that the person who intends to stay at the hotel may act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay

When it is recognized that the person who intends to stay is likely to commit an act contrary to the provisions of laws and regulations, public order or good morals in connection with the stay.

4. When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).

a. When it is deemed that the person who intends to stay falls under item 2

of Article 2 of the Act on Prevention, etc. of Unjust Acts by Organized Crime Groups (Act No. 77 of 1991).

The provisions of Article 7, paragraph 2 or

Article 8, paragraph 2 of the Act on the Elimination of All Forms of Discrimination against Persons with Disabilities shall apply.

8. If the person who intends to stay at the hotel requests the hotel to provide accommodation services to other guests

due to the excessive burden involved in the implementation of such services, the hotel shall provide such services to the person who intends to stay at the hotel.

A request that is likely to seriously impede the provision of accommodation-related services to guests

When the person who intends to stay at the hotel has repeatedly made the demands specified in

Article 5-6 of the Enforcement Regulations of the Inns and Hotels Law

(Note) The reasons specified in the ordinance under Article 12 of the above law shall be as listed in the following items.

a. When a person who intends to stay at the hotel is intoxicated or behaves extremely abnormally and causes trouble to other guests

When it is recognized that there is a likelihood that the person who intends to stay at the hotel will be intoxicated or will cause trouble to other guests

b. When a person who intends to stay in the room is extremely unclean in body or clothes, etc., and is likely to cause

disturbance to other guests.

When it is recognized that there is a risk that the person who intends to stay in the room may cause confusion to other guests because his/her body or clothes are extremely unclean.

Refusal to conclude an accommodation contract

Article 5-2:

The person who intends to stay at the hotel may refuse to enter into a contract of accommodation with the hotel in accordance with the preceding article

In the event that this hotel refuses to enter into a contract of accommodation in accordance with the preceding article, the person wishing to stay may request an explanation of the reasons for such refusal.

The guest has the right to cancel the contract.

Article 6:

1. The guest may cancel the accommodation contract by notifying the hotel.

2. In the event that the guest cancels the accommodation contract, in whole or in part, for reasons attributable to the guest, this hotel shall not be liable for any damage caused by such cancellation.

In the event that the guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (in the event that this hotel specifies the due date for payment of the deposit and requests payment of the deposit pursuant to Article 3, paragraph 2)

3. This hotel will not accept a cancellation of the accommodation contract by the guest without prior notice until 8:00 p.m. on the day of the stay (or until the estimated time of arrival has been clearly indicated in advance)

If the guest does not arrive at the hotel by 8:00 p.m. on the day of the stay (or 2 hours after the prearranged time of arrival, if such time has been clearly indicated) without prior notice, the hotel will not accept the guest.

If the guest does not arrive at the hotel by 8:00 p.m. on the day of the stay (or two hours after the time of arrival if the time of arrival is specified in advance)

If the guest has not arrived at the hotel at the time specified (2 hours after the time), the contract of stay may be deemed cancelled by the guest.

4. In the event that the accommodation contract is deemed to have been cancelled pursuant to the provisions of the preceding paragraph, if the guest has not arrived at the hotel without making such contact

, the hotel may treat the accommodation contract as cancelled by the guest.

In the event that the guest has failed to contact the hotel, the hotel will not be liable for any damage caused by the non-arrival or delay of public transportation such as trains and airplanes,

any other damage caused by the guest.

When the guest proves that the non-arrival or delay was due to reasons beyond the guest's control, the penalty fee in

Clause 2

will be charged.

No penalty fee will be charged in accordance with paragraph 2

The Hotel's right to terminate the contract

Article 7:

1. This hotel may cancel the accommodation contract in the following cases.

However, this paragraph does not apply to cases other than those listed in Article 5 of the Ryokan Business Law, in which this hotel refuses to accommodate guests

However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Ryokan Business Law

1) When a guest is likely to commit an act in connection with his/her stay that is contrary to the provisions of laws and regulations, public order or good morals

When it is recognized that the guest is likely to commit an act contrary to the provisions of laws and regulations, public order or good morals in connection with the stay, or when it is recognized that the guest has committed such an act.

2) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).

a. Boryokudan (organized crime groups), boryokudan members, quasi-constituents of boryokudan, or persons related to boryokudan, or other antisocial forces

(b) When it is a juridical person or other organization whose business activities are controlled by a crime syndicate or a member of a crime syndicate

3) When a guest causes significant inconvenience to other guests.

4) When a guest is a specific person.

4) When a guest is a patient of a specified infectious disease, etc.

5) When a guest is violent or abusive in relation to his/her stay.

5) When a violent act of demand is committed or a burden exceeding a reasonable range is demanded in relation to the accommodation

When the guest has been subjected to an act of violent demand or asked to bear a burden exceeding a reasonable range in relation to the accommodation

(except when the guest requests the removal of social barriers pursuant to Article 7, paragraph 2 or Article 8, paragraph 2 of the Act on Elimination of Discrimination against Persons with Disabilities).

6) When a guest requests that the hotel remove a social barrier that is an excessive burden to carry out and that relates to another guest

Any request made by a guest to the hotel as a request that is likely to significantly impede the provision of services related to the stay at an inn

When a guest repeatedly makes the request specified in

Article 5-6 of the Business Law Construction Regulations

7) When the inn is unable to accommodate guests due to reasons beyond its control, such as natural disasters.

8）When a guest has said or done something slanderous or libelous about the hotel, a specific individual or group

In the event that a guest has made defamatory or libelous statements about the hotel or a specific individual or group, or has spread such statements on social networking sites or websites.

9) When the case falls under the provisions of Article 12 of the Tokushima Prefecture Ryokan Business Law.

(Note) The reasons specified in the ordinance under Article 12 of the above law shall be as listed in the following items.

(a) When it is recognized that the person who intends to stay is intoxicated or acting extremely abnormally and causing trouble to other guests

When it is recognized that the person who intends to stay may cause trouble to other guests

b. When a person who intends to stay in the room is extremely unclean in body or clothes, etc., and is likely to cause trouble to other guests

b) When it is recognized that the person who intends to stay is likely to cause inconvenience to other guests

10) When a person does not comply with the prohibitions in the rules of use established by the hotel.

11) When you do not follow the rules and regulations of the hotel.

1. This hotel shall not be liable to the guest for the performance or non-performance of the accommodation contract and related agreements

Except in the case of natural disasters or other difficulties, the Hotel shall, with the consent of the guest, arrange other accommodations

under the same conditions as far as possible.

In the event that a guest's baggage or personal belongings are left at the hotel, the hotel will request

instructions from the owner of the baggage or personal belongings as soon as the hotel is contacted by the owner. However, if the owner is not contacted or instructed, or if the owner is not known, the hotel will not be held liable for any damage caused by the owner.

If the owner is not contacted or instructed, or if the owner is not known, the property shall be held for 90 days, including the date of discovery, and then disposed of or reported to the nearest police department.

3. Responsibility of the hotel for the safekeeping of the guest's baggage or personal belongings in the case of the preceding two paragraphs

Responsibility for parking

Article 17:
